Introduction

Welcome to ÉMÉ’s webshop, designbyeme.com registered under Decorolux.

Our website and webshop (Sites) and related services are made available to you in accordance with the following Terms of Use & Service, and any other rules posted on our Sites (collectively, the “TOS”). The act of placing an order on the Site, implies that you accept the TOS fully and without reservation. ÉMÉ reserves the right to be able to amend its sales terms at all times. In this case the applicable terms shall be those in force and viewable on the Site on the date of the purchase.

Account and eligibility to purchase

In order to make purchases on the Site you will be required to register, which includes, providing your personal details (real name, phone number, e-mail address and other requested information as indicated). Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.

Products

On designbyeme.com, we only offer new products, marked with the “ÉMÉ” trademark. The main characteristics (e.g. colour, material, available size) of products are shown on each product page. Please note that although the photographs on the Site give as good a representation of each model as possible, they may not exactly correspond to the real garments due to the Internet browser or monitor used.

Orders

ÉMÉ offers products for sale that are in stock and available for dispatch from our HQ. Still, all orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. We reserve the right to refuse any order you place with us. We also may, in our sole discretion, limit or cancel quantities purchased per person. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Occasionally by mistake we may display inaccurate information (typographical errors, inaccuracies or omissions) that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders due to such mistakes. In case your orders are affected, we will attempt to contact you via e-mail and/or billing address/phone number provided.

Pricing

Prices shown on the website are in Hungarian Forint. Prices include VAT at the applicable rate.

Upon checkout – as soon as you indicate your delivery address – the total amount payable will be recalculated to take into account any changes in VAT, import duties and taxes. In some cases import duty or tax costs will be invoiced to you directly from our shipping carrier or an import broker appointed by you. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion.

If you are a customer whose credit/debit card is not denominated in HUF, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

Payment

Payment can be made by Paypal and Visa, Visa Electron, Visa Debit, Visa Delta, MasterCard, Maestro debit cards, and any other methods which may be clearly advertised on the Site from time to time. Payment will be debited and cleared from your account at the end of the checkout process. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment, we will not be liable for any delay or non-delivery.

 

We will keep details of your order and payment secure on a best effort basis. However, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the website.

By clicking the Confirm button the Customer accepts Decorolux, Csemete Utca 10., Budapest, 1036 Hungary at designbyeme.com to provide the following personal data stored in its user database to Decorolux, Csemete Utca 10., Budapest, 1036 Hungary  Provided data: username, family name, given name, country, phone number, e-mail address. The purpose of data transmission: customer support for users, confirming transactions and fraud-monitoring for users defence.

Delivery and insurance

Deliveries are made to the address given in the purchase order. We aim to dispatch all orders within 24 hours. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. As soon as the package was handed over to the career a tracking number will be sent to the email address you provided. This allows you to monitor on the Site the progress of the delivery order.

From the time they are handed over to the carrier, goods are transported at the purchaser’s risk. In the event of damage during transport, complaint must be made to the carrier within a period of three days from delivery. In the event of late delivery, missing items or defects, you should immediately contact the carrier and also inform ÉMÉ via the provided central email address. Please note that delays may occur due to customs clearance processes.

Returns and exchange

If, for any reason you are not satisfied with your order, you may exercise your right to return purchased products within ten (10) working days from the date on which you received them from ÉMÉ. Return items must be shipped back to:

If the items are returned within this timeframe, we will exchange it (we will discuss with you the conditions of exchange) or offer a refund.

The products may be returned to ÉMÉ by any shipping agent. The costs of shipment are at your own expense. You will be responsible for any loss or damage to the products during transit. To return products we kindly ask you to contact our team via the provided email address. Please note that duties, taxes and delivery costs will not be refunded.

In order for us to be able to accept any returned goods and provide you with a replacement item or refund your money, the following conditions have to be fully met:

  • the products have not been used, worn, washed, perfumed, modified or damaged;
  • the identification tag is still attached to the products with the disposable seal;
  • the products must be returned, complete and unused, in their original packaging (if you want to return a kit, it must include all of its components) together with the original invoice;
  • ÉMÉ must receive the return package within 20 days from the date the package was delivered to you.

You will be notified if upon receipt of the returned goods we find that any of the above rules were breached and hence the returned products cannot be accepted. In this case we will return the products to you in the condition in which they were sent back to ÉMÉ. If you do not wish to retain the products we shall be entitled to both keep the products and withhold the sums already received.
